These Terms and Conditions govern your use of My New Driveway, including the remote estimate, driveway visualiser, installer directory and installer-matching services.
1. About these terms
By using this website or submitting information, you agree to these terms. If you do not agree, do not use the service. You must be at least 18 and legally capable of arranging the proposed work or authorised to act for the property owner.
These terms apply to the website service. A separate contract will normally arise between you and an independent installer if you accept that installer’s quotation.
2. What the service provides
My New Driveway provides tools that can:
- collect project details, approximate measurements, photographs and preferences;
- produce an indicative remote driveway price range;
- create illustrative AI-generated driveway concepts;
- verify enquiry details and match a completed enquiry with an installer; and
- publish information about installers, service areas and driveway materials.
We may alter, suspend or withdraw parts of the service where reasonably necessary for maintenance, security, legal compliance or product changes.
3. Indicative estimates are not quotations
Every remote estimate is a guide only. It is not an offer, fixed price, valuation, survey, specification or binding quotation.
The estimate is based on the details supplied, approximate or map-based measurements, selected groundwork assumptions, configured regional or material rates and the information available when it is generated. The final cost can change because of measurement differences, excavation depth, hidden ground conditions, access, drainage, waste, utilities, planning requirements, retaining work, edging, product choice, labour, VAT and other site-specific factors.
You must obtain a physical survey, written specification and final quotation from the installer before authorising work or making a payment.
4. AI visualiser and media analysis
Generated images and AI observations are illustrative concepts only. They may alter or misunderstand boundaries, levels, colours, aggregate, paving patterns, kerbs, drainage, doors, windows, walls, plants or other property features. They are not architectural drawings, planning advice, structural advice or a promise of the finished result.
Do not rely on a generated image to order materials, obtain planning permission, determine drainage compliance or instruct building work.
5. Independent installers
Installers shown on or introduced through the website are independent businesses. They are not our employees, agents or subcontractors unless expressly stated otherwise.
We may carry out identity, insurance, public reputation, Companies House, website and other due-diligence checks. These checks are limited to the information available at the time and do not guarantee an installer’s workmanship, solvency, availability, conduct or continued compliance.
You are responsible for deciding whether to appoint an installer. Before doing so, check current insurance, references, trade memberships, planning and drainage requirements, written scope, exclusions, payment schedule, guarantees and cancellation rights.
6. Lead release and contact
A customer enquiry is not treated as fully verified until the required form sections, email code and manual telephone check have been completed. Where the form explains that details will be released to one installer, the installer receives them only after accepting the verified enquiry or where you have selected that installer for first refusal.
Submission does not guarantee that an installer will accept the enquiry, contact you within a particular time or offer a quotation.
7. Your responsibilities
You agree to:
- provide complete, current and accurate information;
- only submit a property, telephone number, email address, photograph or video that you are entitled to use;
- avoid uploading people, vehicle registrations, private documents or neighbouring property details unless genuinely needed and lawful;
- check the address, dimensions and assumptions before relying on an estimate;
- use the service lawfully and not attempt to bypass verification, limits or security controls; and
- obtain professional advice and permissions where the project requires them.
8. Uploaded content
You retain ownership of content you upload. You grant us a limited licence to store, resize, process, display and share it as necessary to provide the requested estimate, visualisation, installer matching, support and security functions.
Where you separately consent to AI processing, that licence includes sending the selected media to the configured AI provider for analysis or image generation. You can choose not to provide that optional consent.
9. Acceptable use
You must not use the website to submit false leads, impersonate another person, upload unlawful or harmful material, scrape protected content, interfere with the website, probe security, introduce malware or use automated systems in a way that damages or overloads the service.
We may suspend access, remove content or report activity where reasonably necessary to protect users, installers, the website or third parties.
10. Intellectual property
The website design, software, text, brand, graphics and original content are owned by or licensed to My New Driveway and are protected by intellectual property law. You may use the site for your own personal or internal business purpose but may not copy, sell, republish or create a competing database from it without permission.
11. Third-party services and links
The website may use or link to mapping, verification, AI, email, payment, analytics, social media, installer and public-information services. Those services have their own terms and privacy practices. We are not responsible for an external website merely because we link to it.
12. Liability
Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
Subject to that, we are not responsible for:
- differences between a remote estimate or generated image and the actual project;
- an installer’s quotation, advice, delay, workmanship, materials, acts, omissions or insolvency;
- loss caused by inaccurate or incomplete information supplied to the website;
- planning, drainage, boundary, structural, utility or regulatory issues; or
- indirect or business losses that were not reasonably foreseeable from use of the consumer website service.
We do not promise uninterrupted or error-free availability, but this does not affect any rights you have under applicable consumer law.
13. Privacy
Our handling of personal information is explained in the Privacy Policy. You should also review the privacy information supplied by an installer before entering into a contract with it.
14. Changes to these terms
We may update these terms to reflect changes to the service, providers or law. The version displayed when you use a feature will apply to that use. Material changes will be highlighted where reasonably practical.
15. Governing law
These terms are governed by the laws of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you retain any mandatory rights to bring proceedings in your local courts.
